It’s not a free grope, but it’s similar.

NRO - Oct 21/05 -  It doesn’t involve cigars or a stained dress. But the nomination of Harriet Miers has created a woman problem on the Right every bit as big as that which faced feminists during Bill Clinton’s presidency.

For years, conservative women’s groups such as the Independent Women’s Forum have opposed feminist visions of female equality. We opposed affirmative action in the workplace, believing women had to be held to the same standards as men. We rallied against quotas, with the reasoning that if there were fewer female firefighters than male, this was because women didn’t wish to take these jobs, and not because of discriminatory hiring practices by the fire department. We recoiled from the theories of Catharine McKinnon and other so-called “difference feminists” that women deserved special breaks because their personalities were said to be innately more intuitive and sensitive than men’s, and that the female sex is incapable of reasoning logically the way men do. We were disgusted with feminist groups when they stood by Bill Clinton through all his women troubles — when the National Organization for Women, for example, jettisoned all its previously stated principles on sexual harassment in order to retain political power.

Too Stealth


The Miers nomination might be the most catastrophic political miscalculation of the Bush presidency.


Republican presidents have long been drawn to the “stealth strategy” on judicial nominations, picking conservatives, or supposed conservatives, without a public record so it will be harder for Democrats to oppose them. In the John Roberts nomination, a modified stealth strategy reached its height, giving the Court what is likely to be a conservative chief justice for the next 30 years. In the Harriet Miers nomination, the stealth strategy has all but collapsed, producing what might be the most catastrophic political miscalculation of the Bush presidency.

Oct 18/05 - Wash - The truth that is now dawning on many movement conservatives is that George W. Bush is not one of them and never has been. They were allies for a long time, to be sure, and conservatives used Bush just as he used them. But it now appears that they are headed for divorce. And as with all divorces, the ultimate cause was not the final incident, but the buildup of grievances over a long period that one day could no longer be overlooked, contained or smoothed over. 

From the conservative point of view, the list of grievances is a long one, dating back to the first days of the Bush administration. 

-- One of President Bush's first actions in office was a vast expansion of education spending with little real reform in return. To conservatives, it has always looked like a transparent effort to buy off the so-called soccer moms. But rather than buy peace with the education lobby, it has simply led to continuous calls for still more education spending, despite the paucity of evidence correlating spending with achievement.

HEO - Oct 14/05 - As I reported in a series of articles in HUMAN EVENTS (here, here, here, here, and here), since 2004 the U.S. Army has been violating Defense Department regulations regarding the assignment of women in or near land combat. At issue are improper assignments of female soldiers to certain combat support units that collocate (operate 100% of the time) with infantry, armor and Special Operations Forces. Current rules require those units to be all male.

By permitting these illicit assignments, the Defense Department has circumvented a law requiring that it formally notify Congress approximately three months in advance of any such policy change. The law also requires an analysis of the effect such changes could have on the exemption of women from Selective Service registration. None has been provided. 

There are only three explanations for this disappointing situation. As White House counsel, Miers either approved of the Defense Department’s improper assignments of women to units required to be all-male, without prior notice to Congress, or she was unaware of the long-term legal consequences of that practice, or she gave sound advice that the President did not heed.

Within minutes of the nomination of Ms Miers last week, conservative blogs exploded with outrage, providing the first sign of serious conservative discontent over the choice of a woman with no track record on conservative issues, such as abortion, or experience of constitutional law. 

Now the White House is trying to quell the revolt of the blogs: on Wednesday, Ken Mehlman, chairman of the Republican National Committee, reached out to the bloggers who have been leading the charge against Ms Miers in a conference call whose content appeared almost instantaneously on the internet.

During the past nine days, however, the White House's marketing of Miers has been thrown off track. Miers' lack of experience as a judge, her virtually non-existent paper trail on key legal issues and her closeness to Bush have led critics - notably fellow conservatives such as commentators George Will, William Kristol and Charles Krauthammer - to essentially cast Miers as an unqualified crony.

...We've had quite enough dynastic politics over the past decades. (Considering the trouble I have had with Benjamin and William Henry Harrison, I pity the schoolchildren of the future who will have to remember who was who in the Bush-Clinton-Bush-Clinton presidential alternations from 1989 to 2017.) But nominating a constitutional tabula rasa to sit on what is America's constitutional court is an exercise of regal authority with the arbitrariness of a king giving his favorite general a particularly plush dukedom. The only advance we've made since then is that Supreme Court dukedoms are not hereditary.

It is particularly dismaying that this act should have been perpetrated by the conservative party. For half a century, liberals have corrupted the courts by turning them into an instrument of radical social change on questions -- school prayer, abortion, busing, the death penalty -- that properly belong to the elected branches of government. Conservatives have opposed this arrogation of the legislative role and called for restoration of the purely interpretive role of the court. To nominate someone whose adult life reveals no record of even participation in debates about constitutional interpretation is an insult to the institution and to that vision of the institution.

There are 1,084,504 lawyers in the United States. What distinguishes Harriet Miers from any of them, other than her connection with the president? To have selected her, when conservative jurisprudence has J. Harvie Wilkinson, Michael Luttig, Michael McConnell and at least a dozen others on a bench deeper than that of the New York Yankees, is scandalous.

WHAT EVIDENCE DO WE NOW HAVE THAT MIERS DESERVES TO BE TRUSTED WITH A LIFETIME APPOINTMENT TO THE NATION’S HIGHEST COURT? 


Until 2001, Miss Miers’ legal experience was as managing partner of a large corporate law firm. Corporate law, like several other areas of legal practice, does not generally involve constitutional issues. When it does, the lawyer does not educate herself on the issue beyond what is required to adequately represent her client. 


QUESTIONS NEEDING ANSWERS: 



Was Miss Miers’ corporate practice primarily transactional (contract writing and negotiations) or was it primarily litigation? How many of her cases involved constitutional issues? What were the issues? Did Miss Miers do most of the research and writing herself? Has she argued constitutional issues before a court? How many times? In what courts? In how many did she prevail? Are there any published opinions? If so, what are the case names and citations? 


To which of the Founders was Miss Miers referring in her acceptance statement, and why? 


What did Miss Miers mean when she promised to keep our judicial system strong and what would she do to accomplish that commitment? 


Does Miss Miers believe that the Declaration of Independence is important to understanding the U.S. Constitution? 


Is the Constitution the primary source of our rights? 


Does Miss Miers believe that Supreme Court members should consider foreign law when interpreting the meaning of the U.S. Constitution? 


It has been reported that Miss Miers’ favorite Supreme Court Chief Justice is Warren Burger. Why? 


Has Miss Miers authored or co-authored any amicus curiae briefs that argued constitutional issues? If so, in which cases and courts? 


All attorneys are required to attend and complete mandatory continuing legal education courses (M.C.L.E.). How many of Miss Miers' courses have been on the subject of constitutional law? If so, what were the subjects, what were the courses and dates of participation? Has Miss Miers instructed at an M.C.L.E. course on the subject of constitutional law? 


Has Miss Miers spoken or debated on any subject of constitutional law, theory of interpretation, the role of the courts or separation of powers? When, where and on what subjects? 


Is Miss Miers published on any subject of constitutional law? What are the publications, titles and dates of publication? 


Has Miss Miers been a visiting lecturer on constitutional law in any law schools? When, where and on what subject? 


It is reported that in the late 1990s when Miss Miers was a member of the advisory board for Southern Methodist University’s law school she helped initiate a women’s studies lecture series. The lecturers have been women who espouse a radical theory of feminism. Gloria Steinem delivered the series’ first lecture in 1998. In the following two years, the speakers were Patricia S. Schroeder, the former Democratic congresswoman widely associated with women’s causes, and Susan Faludi, the author of Backlash: The Undeclared War Against American Women (1991). Ann W. Richards, the Democrat whom George W. Bush unseated as governor of Texas in 1994, delivered the lecture in 2003.3


Has Miss Miers expressed any opinion about the dominance of feminist theory in the women's studies program? Does Miss Miers share the feminist theory that lecturers have presented? Has she disassociated herself from the lecture series or attempted to bring lecturers to the program that represent a traditionalist perspective on women? Why has she not participated as a lecturer? 


Supporters of Miss Miers point to her work as president of the Texas Bar Association to influence the ABA to adopt a neutral stance on abortion. It did not. Until accepting a position as White House staff secretary in 2001, Miss Miers was still heavily involved in the ABA.4


Why did Miss Miers participate in a voluntary professional association whose amicus briefs do not consistently appeal to a textualist interpretation of the Constitution, which she has promised to do? 


If Miss Miers does not support abortion, why did she continue in leadership positions in the ABA, which does support abortion? If she were not in her current position, would she continue to participate despite its opposition to a constitutional amendment banning same-sex marriage, its support of physician-assisted suicide, the International Criminal Court and requiring the Boy Scouts of America to allow homosexuals to participate as Scout leaders?

Out of Touch !!! Bush Declines to Endorse DeLay's Comments about JUDGES AND TERRI SCHIAVO

ABOARD AIR FORCE ONE - President Bush on Friday said he supports "an independent judiciary" and declined to endorse comments by House Majority Tom DeLay that were critical of judges. 

"I believe in proper checks and balances," Bush said. 


The president, speaking with reporters as he flew to Texas from Rome, where he attended the funeral of Pope John Paul II, was reacting to statements made after the death of Terri Schiavo. 


DeLay, R-Texas, suggested an impeachment case could made against judges who rebuffed Congress' will in the Schiavo case. As the severely brain-damaged Florida woman faded, Congress passed a law allowing federal courts to review the decisions of state judges who turned down her parents' efforts to resume her feeding. But federal judges all the way up to the Supreme Court held up those decisions. 


"The time will come for the men responsible for this to answer for their behavior," DeLay said when Schiavo died.

Oct 21/05 - Harriet Miers -- whose courtesy calls with senators in their Capitol Hill offices have been more chaotic than courteous -- has finished the tour, the White House has told congressional aides.

The meetings have been fraught with misunderstandings and disagreements, giving ammunition to detractors, both liberal and conservative, that Miss Miers is in over her head. 

"No one is walking out of these meetings thinking they've just met with a star," a Republican Judiciary staffer said yesterday.
